By downloading, installing, or using AI Plant Doctor (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and AI Plant Doctor (“we,” “us,” or “our”).
## 2. Description of Service
AI Plant Doctor is a mobile application that provides:
– **Plant Identification**: AI-powered identification of plants from photos
– **Care Instructions**: Detailed care guides for identified plants
– **Health Analysis**: Detection of plant diseases, pests, and nutritional issues
– **Plant Collection**: Ability to save and manage your plant collection
– **Premium Features**: Enhanced features available through subscription
## 3. Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.
## 4. User Accounts
Currently, AI Plant Doctor does not require user account registration. Your data is stored locally on your device. If we implement account features in the future, additional terms may apply.
## 5. Subscription and Payments
### 5.1 Premium Subscription
– AI Plant Doctor offers premium subscription plans with enhanced features
– Subscriptions are billed through Apple’s App Store
– Prices are displayed in the App and may vary by region
### 5.2 Free Trial
– New users receive 3 free plant identifications
– After using free identifications, a premium subscription is required for continued use
### 5.3 Billing
– Payment will be charged to your Apple ID account at confirmation of purchase
– Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
– Your account will be charged for renewal within 24 hours prior to the end of the current period
### 5.4 Cancellation
– You may cancel your subscription at any time through your Apple ID account settings
– Cancellation takes effect at the end of the current billing period
– No refunds are provided for partial subscription periods
### 5.5 Price Changes
– We reserve the right to change subscription prices
– Price changes will be communicated in advance
– Continued use after price changes constitutes acceptance
## 6. Acceptable Use
You agree NOT to:
– Use the App for any illegal purpose
– Attempt to reverse engineer, decompile, or disassemble the App
– Interfere with or disrupt the App’s functionality
– Use automated systems to access the App
– Upload malicious content or viruses
– Violate any applicable laws or regulations
– Infringe upon intellectual property rights
– Use the App to harm plants, animals, or the environment
– Misuse the identification results for commercial purposes without permission
## 7. Intellectual Property
### 7.1 Our Rights
– The App, including its design, features, content, and code, is owned by AI Plant Doctor
– All trademarks, logos, and service marks are our property
– You may not copy, modify, or distribute our intellectual property without permission
### 7.2 Your Rights
– You retain ownership of photos you take or upload
– By using the App, you grant us a limited license to process your photos for identification purposes
– This license is solely for providing the App’s services
## 8. AI-Generated Content
### 8.1 Nature of AI Results
– Plant identification and care recommendations are generated by artificial intelligence
– Results are provided for informational purposes only
– AI results may not always be 100% accurate
### 8.2 No Guarantee
– We do not guarantee the accuracy of plant identifications
– Care instructions are general guidelines and may not apply to all situations
– Health analysis should not replace professional botanical or agricultural advice
## 9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
– Merchantability
– Fitness for a particular purpose
– Non-infringement
– Accuracy or reliability of results
We do not warrant that:
– The App will be uninterrupted or error-free
– Defects will be corrected
– The App is free of viruses or harmful components
– Plant identifications will be accurate
## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
– We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
– We shall not be liable for any loss of profits, data, or goodwill
– Our total liability shall not exceed the amount you paid for the App in the past 12 months
– We are not responsible for any harm to plants based on our recommendations
– We are not liable for any allergic reactions or injuries related to plant handling
## 11. Indemnification
You agree to indemnify, defend, and hold harmless AI Plant Doctor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
– Your use of the App
– Your violation of these Terms
– Your violation of any third-party rights
– Any content you submit through the App
## 12. Third-Party Services
### 12.1 OpenAI
– The App uses OpenAI’s API for plant identification
– Your use is subject to OpenAI’s terms of service
– We are not responsible for OpenAI’s services or policies
### 12.2 Apple App Store
– The App is distributed through Apple’s App Store
– Your use is subject to Apple’s terms and conditions
– Apple is not responsible for the App or its content
## 13. Modifications to Service
We reserve the right to:
– Modify or discontinue the App at any time
– Change features, functionality, or content
– Update these Terms with reasonable notice
– Limit or restrict access to certain features
## 14. Termination
### 14.1 By You
– You may stop using the App at any time
– Uninstalling the App terminates your use
### 14.2 By Us
We may terminate or suspend your access if you:
– Violate these Terms
– Engage in fraudulent activity
– Abuse the App or its services
### 14.3 Effect of Termination
– Your right to use the App ceases immediately
– Provisions that should survive termination will remain in effect
## 15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Turkey.
## 16. Dispute Resolution

### 16.2 Binding Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Plant Doctor regarding the App.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
